Terms of Service

1. Introduction & Acceptance
These Terms of Service (“Terms”) govern your access to and use of Clustter (“Clustter”, “we”, “our”, “us”), including all content, features, and services provided through Clustter.in (the “Platform”).
These Terms form a legally binding agreement between:
- Clustter; and
- You, whether as a Client (event agency, organizer, or business hiring staff), a Freelancer/Talent (individual offering event services), or a general user of the Platform.
By creating an account, submitting a booking request, accepting an assignment, or accessing any part of the Platform, you confirm that:
- You have read and understood these Terms;
- You agree to comply with and be bound by these Terms;
- You accept our Privacy Policy, and any guidelines published on the Platform;
- If using Clustter on behalf of an organization, you are authorized to bind that entity.
If you do not agree to these Terms, you must discontinue use of the Platform immediately.

2. About Clustter & Overview of Services
Clustter is a event management freelancing & staffing company designed to help event companies, agencies, and organizers find trained, pre-vetted, and reliable event staff and freelancers.
We provide talent for multiple event categories, including weddings, corporate events, exhibitions, festivals, travel events, brand activations, concerts, and more.
2.1 What Clustter DOES
Clustter provides the following services:
- Talent discovery, matching, and roster creation.
- Staffing operations: selection → assignment → coordination → payout.
- ID verification, experience validation, and professional grooming guidelines.
- Freelancer onboarding, training, and profile management.
- Payment facilitation between Clients and Freelancers.
- Supervisor-led coordination for certain events.
2.2 What Clustter DOES NOT DO
Clustter does not:
- Employ Freelancers as full-time, part-time, or contractual employees.
- Guarantee availability of specific talent.
- Guarantee event outcomes or performance quality.
- Provide insurance, benefits, or statutory protections to Freelancers.
- Assume responsibility for on-ground incidents unless expressly agreed in writing.
3. User Accounts & Responsibilities
3.1 Account Creation
To access Clustter, users must:
- Be at least 18 years of age.
- Provide accurate and verifiable information.
- Maintain an active email address and phone number.
- Not create duplicate or fake accounts.
Clustter may require ID verification at any stage.
3.2 Responsibilities of Clients
Clients must:
- Provide truthful event requirements.
- Ensure event conditions meet safety standards.
- Maintain necessary event insurance.
- Pay all invoices, taxes, and fees on time.
- Not engage talent for unlawful, harmful, or hazardous activities.
3.3 Responsibilities of Freelancers
Freelancers must:
- Provide accurate personal, professional, and experience information.
- Maintain professional behavior, grooming, and event etiquette.
- Follow instructions given by Client or Clustter supervisors.
- Arrive on time and complete assigned duties.
- Not send substitutes without approval.
- Not engage in misconduct, harassment, or unsafe activities.
3.4 Account Security
Users are responsible for:
- Keeping login credentials safe.
- All activities performed through their account.

4. Bookings, Payments & Pricing
4.1 Booking Process
A booking becomes confirmed only when:
- The Client submits staffing requirements; and
- Clustter provides a roster/quote; and
- The Client approves it digitally; and
- Advance/booking payment is received (if applicable).
Clustter may decline or modify booking requests at its discretion.
4.2 Pricing & Fees
Pricing is based on factors such as:
- Type of manpower needed
- Event duration
- Skills required
- Event location and timing
- Demand and availability
Taxes (GST or others) may apply.
4.3 Invoicing & Payment Terms
- Client invoices may be due before, during, or after the event as agreed.
- Late payments may delay or cancel staffing assignments.
- Revised invoices may be issued for extra hours, added talent, or last-minute changes.
4.4 Freelancer Payouts
Freelancers are paid:
- Within 7–14 working days after event completion;
- Subject to successful client payment;
- After verification of attendance and role completion.
4.5 Cancellations & Refunds
Client Cancellations
- 7+ days before event → 100% refund
- 3–6 days before event → 50% refund
- 0–2 days before event → Non-refundable
Freelancer Cancellations / No-Shows
- May result in temporary suspension or permanent removal.
- Clustter will attempt replacement on a best-effort basis but does not guarantee availability.
Chargebacks
Clustter may place disputed funds under temporary dispute hold until the issue is resolved.
5. Independent Contractor Relationship
Freelancers engaged through Clustter are independent contractors, not employees of:
- Clustter
- Clients
- Any partner agencies
Freelancers are responsible for:
- Their taxes, PF/ESI, and statutory obligations.
- Arranging their own insurance, if desired.
- Their conduct and performance during events.
6. Verification, Safety & Insurance Requirements
6.1 Verification
Clustter may conduct ID verification, experience checks, and background assessments.
However, Clustter does not guarantee:
- Accuracy of freelancer-provided information;
- Absence of criminal or adverse history.
6.2 Client Responsibilities
Clients must ensure:
- Venue and event safety standards are maintained.
- Local laws and compliance requirements are met.
- Appropriate event insurance is in place.
6.3 Freelancer Responsibilities
Freelancers must:
- Follow all safety protocols.
- Comply with venue rules and local regulations.
7. Replacements, No-Shows & On-Ground Issues
- Clustter will attempt best-effort replacements for unexpected cancellations.
- Replacements are dependent on availability and not guaranteed.
- Severe or repeated freelancer issues may result in account termination.
- Clients may request additional support or supervisors; additional charges may apply.
8. Performance, Ratings & Feedback
- Clients may provide ratings and feedback after each event.
- Ratings impact freelancer visibility, ranking, and assignment priority.
- Repeated poor performance may result in removal from the Platform.
- Feedback may be used for training, performance improvement, or profile visibility.
9. Subcontracting & Third-Party Partners
Clustter may subcontract elements of staffing, training, logistics, or coordination to trusted third-party vendors.
You consent to such subcontracting as long as service standards are reasonably maintained.
10. Intellectual Property Rights
All content on the Platform, including text, imagery, branding, UI/UX design, software, and operational processes, is owned by Clustter.
Users grant Clustter a license to use:
- Profile information
- Images
- Reviews
- Experience descriptions
- For operational, marketing, and quality control purposes.
Unauthorized copying, scraping, data mining, or reverse engineering is prohibited.
11. Confidentiality
Users must keep confidential:
- Client lists
- Event details
- Pricing information
- Operational processes
- Documents shared by Clustter
Confidential information may not be shared, sold, or disclosed without written consent.
12. Liability, Warranty Disclaimer & Limitations
To the extent permitted by law:
- Clustter is not responsible for actions, omissions, or performance of Freelancers or Clients.
- Clustter is not liable for injuries, damages, losses, delays, or disruptions occurring during events.
Liability Cap
Clustter’s maximum liability to any Client shall not exceed the total booking amount paid for the disputed service.
13. Indemnification
Users agree to indemnify and hold Clustter harmless from claims, damages, losses, liabilities, and expenses arising from:
- Breach of these Terms;
- Misconduct or negligence;
- On-ground incidents;
- Violation of law.
14. Termination & Suspension
Clustter may suspend or terminate accounts for:
- Fraud or misrepresentation
- Repeated no-shows
- Abusive behavior
- Legal violations
Upon termination:
- Outstanding invoices remain payable.
- Account data may be retained as required by law.
15. Amendments
Clustter may modify these Terms at any time. Continued use of the Platform constitutes acceptance.
Users will be notified via email or platform notice for material changes.
16. Privacy & Data Protection
Use of the Platform is subject to the Privacy Policy available at: https://clustter.in/privacy-policy/

18. Severability & Entire Agreement
If any clause is held invalid, the remaining clauses remain enforceable.
