This Privacy Policy describes the practices of Clustter (“Company”, “We”, “Us”, “Our”), an India-based online freelancing platform that facilitates the connection between event management organizations seeking manpower and individuals seeking freelance project-based event work. This Policy explains how Clustter collects, uses, stores, processes, transfers, and protects personal information when users access or interact with the platform Clustter.in or any of its services.
By accessing, registering, or using the Platform, you acknowledge that you have read, understood, and consent to this Privacy Policy.
1. Definitions
For the purpose of this Policy:
Term Definition
Platform: Refers to the online website Clustter.in and any associated mobile platforms, tools, or communication systems.
Freelancer / Independent Contractor: Any individual above 18 years of age registering voluntarily to offer event-based freelance services. No employment, contract of service, or master-servant relationship is created.
Client / Hiring Partner: Event management companies, production houses, agencies, or businesses seeking freelance manpower for events.
User: Refers collectively to Freelancers, Clients, and visitors accessing the Platform.
Personal Data / Personal Information: Any information that identifies or can be used to identify a natural person.
Sensitive Personal Data: As defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, including ID proof, financial account details, etc.
Process / Processing Collecting, storing, using, transmitting, sharing, disclosing, archiving, or deleting data.
2. Nature of Services & Relationship Disclaimer
Clustter is only an intermediary and digital aggregator providing a technology-based platform for Clients to connect with Freelancers.
Freelancers are not employees, workers, interns, partners, or agents of Clustter.
Clustter does not employ, supervise, control, or set working hours for Freelancers.
Payments between Clients and Freelancers are independent contractual engagements.
Clustter does not determine rates, wages, work conditions, or service requirements for Freelancers.
No relationship under the Industrial Disputes Act 1947, Contract Labour Act 1970, Minimum Wages Act, Shops & Establishment Act, EPF Act, ESI Act, or similar labour-related laws is created.
By registering, Freelancers acknowledge that they provide services voluntarily at their own discretion and professional capacity.
3. Applicability
This Privacy Policy applies to:
- Individuals registering as Freelancers
- Event management companies, agencies, production houses, and brands registering as Clients
- Visitors who use or browse Clustter.in
